IP for the Public Sector: An Intellectual Property Primer - Understanding and Using IP Effectively in the Public Sector

Public sector officers have to deal with intellectual property (IP) in their everyday work. However, not all forms of IP are instantly or intuitively recognisable. Officers who are unfamiliar with IP issues are at risk of incurring penalties for IP infringement, or failing to capitalise on and protect their organisation’s IP assets. For example, officers may not think to secure the permissions needed to use photos and text from external sources when putting together a publication for their own organization. In other situations, they may fail to ensure that their organization retains the right to use and adapt the IT system that they contracted a vendor to develop.

The IP Academy’s Intellectual Property Primer gives participants grounding in all the major forms of IP and its role in the products and services of government agencies.

The course will be conducted by a team of tutors from the Intellectual Property Office of Singapore (IPOS) who have in-depth knowledge of the subject matter and will share their own as well as other agencies’ experiences in dealing with IP.

At the end of this 2-day IP Primer course, participants will:

• be familiar with the various forms of IP;

• understand how IP assets may be more effectively managed in the public sector; and

• be able to identify the possible IP issues that may arise in their work.

Coverage

Day 1

1. An Introduction to IP Policies in the Public Sector

IP principles and guidelines in the Instructional Manuals (IM) and Financial Circular Minutes (FCMs) for procurement and publicly-funded R&D.

2. Copyright

Basic principles and fundamentals of copyright, ownership, liabilities, enforcement, fair dealing and licence clearances, copyright in government materials, exemptions for government and educational use.

3. Government Marks

About corporate logos, public programme logos, certification marks, state emblem etc., how they may be protected, how they may be used by different agencies, possible abuses to watch out for and the practical considerations in registering and using the mark.

Day 2

4. Patents

Basic principles and fundamentals of patent protection, processes for applying for a patent, issues to keep an eye out for including inventorship & ownership, maintaining novelty, security clearances, costs etc.

5. Registered Designs

Basic principles and fundamentals of protection of designs, processes for applying for a design registration, issues to keep an eye out for including maintaining novelty, limitations, interface with other forms of IP etc.

6. Confidential Information (CI)

Definition and scope of protection of confidential information (CI), balancing public interest with policy considerations or confidentiality, measures to protect CI, obligations arising from employment as public sector officers and handling of classified materials. The relationship between CI and other forms of IP rights will also be explored.

7. An IP Case Study

Participants will ‘walk through’ a scenario to see how the various IP rights and their application in work situations may result in complex issues.
