Intellectual Property (IP) Primer: Understanding and Using Intellectual Property Effectively

IP cannot be ignored.

IP has become part and parcel of a company’s arsenal in ensuring its competitive edge. IP issues are key discussion items at bilateral and international platforms.

 

IP is becoming increasingly pervasive.

Consumers are told to “buy original” and news articles feature cases being fought over copyrighted works, trade marks and patents. Government officers are realizing that they face IP issues every day.

 

 

Have you ever?

Did you consider the IP issues?

Put together a publication including photo inserts, news clippings, snippets of private journals?

If you have the right to use these creative works?

 

Developed a catchy tagline and logo to brand a programme?

What may happen if others were to use the marks without your permission?

Appointed a vendor to come up with an IT system for sharing information with others in your agency?

If you had retained the right to use and adapt the system for other purposes?

Provided materials for an external training session?

What confidential information may have been revealed?

 

Officers who ignore IP may

-       Risk infringing the IP rights of others, and

-       Not get the full value of assets created in the course of their work or from projects funded by    
        the government.

 

At the end of the IP Primer, officers should

-       Gain a better understanding of the various forms of IP,

-       Know how IP assets may be used in the public sector and

-       Identify the possible IP issues that may arise in the course of their work.

 

 

More about the course and the speakers

 

IP rights are inter-related. Many forms of IP may exist in one product or may be developed in the course of a project. A holistic understanding of the various forms of IP is necessary to avoid being blindsided.

 

Participants in the IP Primer will not be flooded with legal and technical information. Scenarios and examples are used throughout allowing participants to better relate to IP in real life.

 

The team of tutors from the Intellectual Property Office of Singapore (IPOS) has in-depth knowledge of the subject matter and will share their own as well as other agencies’ experiences in dealing with IP.

Day 1:

 

0830:    Registration

 

0900:    An Introduction to IP Policies in the Public Sector

            

Coverage: IP Principles and Guidelines in the IM and FCMs for Procurement and Publicly Funded R&D.

 

0930:    Copyright

 

Coverage: Basic principles & fundamentals of copyright, ownership, liabilities, enforcement, fair dealing and licence clearances, copyright in government materials, exemptions for government & educational use.

1300:    Lunch Break (meals not provided)

1400:   Government Marks

Coverage: About corporate logos, public programme logos, certification marks, state emblems etc., how they may be protected, how they may be used by different agencies, possible abuses to watch out for  and the practical considerations in registering and using the mark.

 

1730:     End

 

Day 2:

0900:    Patents

 

Coverage:  Basic principles and fundamentals of patent protection, processes for applying for a patent, issues to keep an eye out for including inventorship & ownership, maintaining novelty, security clearances, costs etc.

  

1230:    Lunch Break (meals not provided)

                                   

1330:    Registered Designs

  

Coverage:  Basic principles and fundamentals of protection of designs, processes for applying for a design registration, issues to keep an eye out for including, maintaining novelty, limitations, novelty, interface with other forms of IP etc.

 

1530:    Confidential Information (CI)

 

         

Coverage: Definition and scope of protection of CI, balancing public interest with policy considerations for confidentiality, measures to protect the CI, obligations arising from employment as public sector officers and handling of classified materials. The relationships between confidential information and other forms of IP rights will also be explored.

 

1700:    Wrap-up: Walking Through an IP Case

 

Participants will ‘walk through’ a scenario which will illustrate how the various IP rights and their application in work situations may result in complex issues. Armed with the fundamentals provided from the earlier modules, participants should be able to identify these issues and think through how these issues may be dealt with.
